General terms and conditions

Article 1. General information

These general terms and conditions are intended to inform you about your/our rights and obligations on the website www.student.be (hereinafter, the “Platform”). We also place at the heart of this mission our commitment to transparency regarding the data collected about you, how it is used, and the entities with which we may share it.

“you” or “User” refers to any person who visits or interacts with the Platform. “Member” refers to a User who has created an account on the Platform. These General Terms and Conditions apply to all services offered on the Platform or offered by the Platform operator, Student.be as defined below (“Services”), including off-site Services such as advertising and marketing campaign services.

Article 2. Contract

You acknowledge that by clicking “Sign up”, or a similar element, by registering for our Services, accessing them, or using them, you have: (i) read these General Terms and Conditions; (ii) expressly accepted all the rights and obligations mentioned therein; and (iii) agreed to enter into a contract that is legally binding on you with the Platform (even if you use our Services on behalf of a third party). If you do not accept this contract (the “Contract” or the General Terms and Conditions), do not click “Sign up” (or any similar element) and refrain from accessing or using our Services and Platform.

If you wish to terminate this Contract, you may do so at any time by closing your account and no longer using our Services and Platform. By continuing to use the Platform or our Services after the announcement of, or notification of, changes to the General Terms and Conditions, the User—and even more so the Member—acknowledges having accepted said changes.

Article 3. Legal notices

The Platform is operated by Dimijob SPRL, established at 1150 Woluwe-Saint-Pierre, Avenue des Châtaigniers 10, and registered under no. 0888.468.629 with the Crossroads Bank for Enterprises (hereinafter, “we” or “Student.be”).

Article 4. Obligations of Members and Users

To use the Services, you must: (1) hold only one account on the Platform under your real name and identity; and (2) not have been banned by the Platform from using its Services. Creating an account using false information constitutes a breach of these General Terms and Conditions, particularly in the case of accounts registered in the name of third parties. You are responsible for any use of your account unless you close it or report misuse.

If you apply for a student job or housing listing, you must:

(1) meet the minimum legal age required or older to accept student jobs and be legally bound (for applying to a student job, this means being at least 16 years old and “being a student,” i.e., following full-time education, or being 15 years old and having completed the first two years of secondary education, unless these rules are subject to legislative changes); and

(2) provide accurate and correct data relating to your status and identity.

If you apply for internships or other offers for young graduates, you also undertake to provide only accurate data regarding your profile, education/academic background, and status.

Members are account holders. You agree:

(1) to use a strong password and keep it confidential;

(2) to comply with the law; and

(3) you guarantee the truthfulness of the information contained in your Profile and in any publications or listings you post.

You agree that we may send you notifications and messages via:

(1) the Platform; or (2) the contact details you provided (e.g., email, mobile number, postal address). You agree to keep your contact details up to date. Our Services allow messages to be sent through your profile and/or your email. In accordance with available settings, we will respect your preferences regarding visibility of content and information. For more information on the protection of your personal data, please refer to Article 7 below.

**Sharing listings on the Platform:** You undertake to provide only content and data that do not infringe any law and do not violate anyone’s rights (including intellectual property rights). You also guarantee the truthfulness of the information contained in such listings. Listings posted on the Platform must also comply with these publication rules:

- Listings for “multi-level” sales systems (where person A receives a commission on person B’s sales) are prohibited and will be removed.

- By posting your listing, you authorize Student.be to distribute its text and photos in: a newsletter, a blog, social media, or otherwise.

- We reserve the right to remove a listing for any reason.

- We disclaim all responsibility for the content of listings and the links to which they refer.

- The Platform reserves the right to select and/or remove at any time and without prior notice any listing, link, reference to referenced sites or partners, or any published information.

These provisions apply to all listings posted on the Platform.

Article 5. Provision of Services by the Platform and Student.be

**Access and navigation:** The Platform is accessible free of charge to any User with internet access. The User bears all costs related to accessing the Platform. The Platform takes all reasonable measures to ensure proper operation, security, and accessibility. However, the Platform offers no guarantee of operability and acts under an obligation of means. The Platform bears no liability in the event of temporary or permanent inaccessibility.

**Content:** Although information published on the Platform is considered reliable, content is mainly provided by Members (notably listings), third-party sites, or partners. The Platform and Student.be do not review content published by members and partners. Consequently, the Platform cannot guarantee the quality of information on the Platform. Information may not always be complete, accurate, sufficiently precise, or up to date. The Platform cannot be held liable for direct or indirect damages suffered by the User due to information on the Platform or in a listing.

Despite regular updates, Student.be’s liability cannot be engaged in the event of incomplete or erroneous information communicated on the Platform. Partners and third parties are responsible for the listings they publish. Despite verification efforts, errors may appear and third parties may attempt fraud. If you become aware of errors or attempted fraud, please report them immediately to: [contact@student.be](mailto:contact@student.be). The Platform disclaims liability for errors in Members’ publications or for viruses that may infect the User’s or Member’s equipment after use or access, although security measures are in place. The Platform is not liable in the event of unforeseen events or force majeure.

**Third-party content and links:** The Platform includes listings, hyperlinks, advertising banners, and redirects to third-party or partner sites. Clicking them will take the User outside the Platform. The Platform has no control over, and is not liable for, the content of web pages linked to these sites. Referenced websites are independent, and no legal relationship (agency, partnership, joint venture, employment, franchise) is intended, exists, or is created between the Platform and any User/Member or referenced site. The Platform excludes liability for damages resulting from use of referenced sites or listings.

**Restrictions:** Student.be reserves the right to limit your use of the Services, including your ability to contact other Members. Student.be may restrict, suspend, or close your account if you do not comply with this Contract or the law, or if your use is abusive.

**Liability:** Student.be is exclusively liable to you for direct damages caused by its negligence or intentional fault. Student.be assumes no liability for lost profits or opportunities (including commercial or housing), reputational damage, loss of data or content, their use, or any indirect, incidental, or consequential damages (including loss of profits/revenue/turnover, financial loss, increased overhead, disruption of planning, business interruption costs, reputational harm, or loss of customers), even if foreseeable. In all cases, Student.be’s liability is limited to EUR 3,000. This limitation does not exclude liability in case of fraud or intentional misconduct.

Article 6. Intellectual property

**Platform content:** Trademarks, logos, texts, software, scripts, graphics, photos, listings, sounds, music, and all Platform content are protected by intellectual property rights, mainly copyright.

Any reproduction, communication, copying, or use other than private use requires prior written authorization from the Platform and Student.be. Any reproduction, representation, adaptation, translation, transformation (in whole or part), or transfer to another site is prohibited. Any partial or total reproduction without Student.be’s prior written consent is strictly prohibited.

Violation of this provision exposes the offender to civil and criminal penalties, including compensation for the Platform’s damage assessed at a flat rate of EUR 3,000 per infringement, without prejudice to Student.be’s right to claim full compensation if the damage exceeds that amount.

**Third-party content (Members/Users/partners):** The Platform also contains trademarks, logos, listings, and content from advertisers and Members/Users. By publishing content on the Platform, you guarantee you have sufficient rights and authorizations and you grant the Platform a free, non-transferable, worldwide license to use it. This license includes rights of reproduction, modification, and public communication in the broadest interpretation most favorable to the Platform.

If you are not the direct owner, you guarantee you have the necessary authorizations from the relevant right holders. In case of a problem, you agree to be solely responsible, to indemnify the Platform for any damage, and not to hold the Platform liable.

The license lasts for the entire contractual relationship and is granted free of charge for worldwide exploitation. Upon your request, use of your intellectual property rights may be terminated after written notice to the Platform. The Platform must then stop using your intellectual property rights for the future within thirty (30) working days of your written notice.

Article 7. Cookies

**Principle:** The Platform uses cookies to enable access and improve your browsing experience.

A cookie is a small text file saved on your device via your browser. It contains information that uniquely identifies your browser. Each time you connect, the Platform can recognize your browser. Cookies are used to improve browsing performance. The Platform (and its hosting provider) mainly uses navigation cookies, language detection cookies, and Google Analytics. You can manage and customize cookie use via the Axceptio banner.

**Cookie duration:** Depending on the type, cookies may be deleted when you close the browser (“session cookies”) or stored until manually deleted or expiration (“persistent cookies”). Storing cookies does not in itself disclose personal information.

**Purposes:** When you visit the Platform, we use:

- **Functional cookies:** necessary for Site navigation. If you refuse them, you will not be able to use the Site.

- **Social network cookies:** third-party applications enabling content sharing. These cookies are not managed by the Platform; refer to the relevant social networks’ cookie policies.

- **Video playback cookies:** necessary to play videos on third-party platforms such as YouTube. Their use requires your consent. If refused, some functionalities may be unavailable.

- **Analytics cookies:** such as Google Analytics, used to create traffic statistics (most visited pages, exit pages, visit duration, etc.) to improve performance and user experience.

Use of these cookies is subject to your consent. If you refuse them, the Platform remains accessible but some functionalities may be affected. You can disable cookies at any time via browser settings and the Platform cookie banner. You can also identify and manage cookies on your device by consulting the relevant browser help pages (Chrome, Edge, Firefox, Safari — desktop and mobile). The Platform is not responsible for the accessibility or content of those pages.

Article 8. General provisions

The nullity or inapplicability of one clause does not affect the validity or applicability of the remaining clauses. Where applicable, the disputed clause will be replaced by a valid clause that is economically closest to the invalid clause. The Platform’s failure to enforce these General Terms at a given time cannot be interpreted as a waiver of the right to enforce them later.

Article 9. Applicable law and competent courts

These General Terms and Conditions are governed by Belgian law. If no amicable settlement is reached in the event of a dispute between the parties, the competent Brussels courts will have jurisdiction to resolve the dispute. This jurisdiction clause does not prevent a User who is a consumer or a data subject for data protection purposes from bringing proceedings before the courts of their place of residence or any other court with mandatory jurisdiction under Belgian law.
